1. Acceptance of Terms

Welcome to STONEYSHOP ("STONEYSHOP," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (the "Site"), and any purchase you make through it.

By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

We reserve the right to update these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By using the Site, you represent that you meet this requirement. If you are under 18, you may only use the Site with the involvement of a parent or legal guardian.

3. Products, Descriptions & Mockups

All products sold through STONEYSHOP are made to order via print-on-demand manufacturing.
Product photos, mockups, and renderings are representative only. Actual colors, print placement, and fabric texture may vary slightly due to monitor display settings, production batch variation, and the nature of print-on-demand manufacturing. Minor variation is not considered a defect.
We reserve the right to limit quantities, discontinue products, or correct pricing/description errors at any time without prior notice.
We make reasonable efforts to display accurate pricing and product information but do not warrant that product descriptions or other content on the Site are error-free.

4. Orders & Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or inability to verify payment.
Payment is processed at the time of order through Shopify's payment infrastructure and associated third-party payment processors. We do not store your full payment card information.
You are responsible for providing accurate shipping and billing information. STONEYSHOP is not liable for orders misdirected due to inaccurate information provided by the customer.

5. Production & Shipping

Because items are printed and manufactured to order through our fulfillment partner(s), including Tapstitch, production times are separate from and in addition to shipping times. Estimated production and shipping windows will be posted on the Site but are not guaranteed.
STONEYSHOP is not liable for delays caused by our fulfillment or shipping partners, customs processing, weather events, carrier disruptions, or other circumstances outside our reasonable control.
Risk of loss and title for products passes to you upon our delivery to the carrier. STONEYSHOP is not responsible for lost, stolen, or delayed packages once they have been handed to the shipping carrier, though we will make reasonable efforts to assist in resolving carrier issues.
International customers are responsible for any customs duties, import taxes, or fees assessed by their country.

6. Returns, Exchanges & Refunds

Because all products are custom, made-to-order print-on-demand items, all sales are final except as described below.

We will offer a replacement or refund, at our discretion, only in the following cases:

The item arrives damaged or defective.
The item received is materially different from what was ordered (wrong size, wrong design, wrong color due to our error).
The order is lost in transit and confirmed as such by the carrier.

Claims must be submitted within 30 days of delivery, with photo evidence of the issue, to stoneyshop@duck.com

We do not accept returns or exchanges for buyer's remorse, incorrect size selected by the customer, or minor variations in color/print placement inherent to print-on-demand production.

Approved refunds will be issued to the original payment method within a reasonable time after approval.

7. Intellectual Property

All designs, graphics, logos, artwork, the STONEY name and branding, and all content on the Site are the property of STONEYSHOP or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, sell, or create derivative works from any STONEY design or content without our prior written consent.
Purchasing a product does not grant you any license or ownership rights in the underlying design beyond the physical item purchased. You may not use STONEY designs for commercial resale or reproduction.
If you believe any content on the Site infringes your intellectual property rights, contact us at stoneyshop@duck.com with details of the claim.

8. Prohibited Conduct

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms.
Attempt to reproduce, reverse-engineer, or resell STONEY products or designs without authorization.
Use automated systems (bots, scrapers) to access the Site.
Submit false, fraudulent, or misleading information when placing an order, including fraudulent payment information.
Interfere with or disrupt the security or functionality of the Site.

We reserve the right to refuse service, cancel orders, or terminate access to the Site for any user who violates these Terms.

9. Third-Party Services

The Site operates using Shopify's e-commerce platform and relies on third-party services for payment processing, order fulfillment (including Tapstitch), shipping, and related functions. We are not responsible for the acts, errors, omissions, or service interruptions of these third parties, though we will make commercially reasonable efforts to assist in resolving issues that arise from their services.

10. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.

We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, STONEY and its owner(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of the Site or purchase of products, even if advised of the possibility of such damages.

In all cases, STONEY's total liability to you for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless STONEY, its owner(s), and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, misuse of the Site, or infringement of any third-party rights.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
Before filing a formal claim, you agree to first contact us at stoneyshop@duck.com to attempt to resolve the dispute informally.
Any dispute not resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Fresno, California, and you consent to personal jurisdiction there.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other posted policies (shipping, refund), constitute the entire agreement between you and STONEY regarding your use of the Site and supersede any prior agreements.
